Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Reel Fishing Dynamics mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Nathan Wilkins / Reel Fishing Dynamics ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Reel Fishing Dynamics provides a platform for fishing tournament management, charter booking, and personal fishing log features, including:

• Tournament Hub: Browse, register for, and host fishing tournaments
• Charter Hub: Browse and book fishing charters; captains may list their services
• Fishing Dashboard: A personal catch log, tackle box manager, analytics, and social features (Pro subscription required)
• Water Intelligence: Real-time water conditions, tidal data, and fishing spot information

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you are at least 13 years old. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. User Accounts

Certain features of the Service require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and notify us immediately of any unauthorized access
• Accept responsibility for all activities that occur under your account

We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period.

5. Subscriptions and Payments

5.1 Pro Subscription

Access to the Fishing Dashboard requires a paid "Reel Fishing Dynamics Pro" subscription. Subscriptions are available on a monthly or yearly basis.

5.2 Billing

Payments are processed through Apple's App Store or other authorized platforms. By subscribing, you authorize charges to your payment method on a recurring basis at the then-current subscription rate.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through your device's App Store account settings. Cancellation takes effect at the end of the current billing period. Refunds are governed by Apple's App Store refund policy. We do not issue refunds directly.

5.4 Price Changes

We reserve the right to modify subscription pricing. We will provide reasonable notice of any price changes. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. User-Generated Content

The Service may allow you to submit, upload, or share content such as catch logs, photos, tournament results, and reviews ("User Content"). By submitting User Content, you:

• Represent that you own or have the rights to share the content
• Grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content in connection with operating the Service
• Agree that your User Content does not violate any third-party rights or applicable laws

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or inappropriate.

7. Tournament and Charter Listings

Tournament hosts and charter operators are responsible for the accuracy of their listings. We do not guarantee the accuracy, completeness, or quality of any tournament or charter information posted on the Service.

We are not a party to any agreement between users and tournament hosts or charter captains. Any disputes arising from tournament participation or charter bookings are solely between the parties involved.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Post false, misleading, or fraudulent tournament or charter listings
• Harass, threaten, or harm other users
• Attempt to gain unauthorized access to any part of the Service or its systems
• Use automated tools (bots, scrapers, crawlers) to access the Service without written permission
• Impersonate another person or entity
• Interfere with the proper functioning of the Service

9. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of Nathan Wilkins / Reel Fishing Dynamics and are protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Water and weather data provided through the Service is for informational purposes only and should not be relied upon for safety-critical decisions.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY NORTH CAROLINA LAW, IN NO EVENT SHALL NATHAN WILKINS / REEL FISHING DYNAMICS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Nathan Wilkins / Reel Fishing Dynamics and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in North Carolina, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the Effective Date at the top of this document and, where appropriate, notify you via email or in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
